A. Cancellation Policy

Introduction

Consumers have a right of cancellation in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity.

Right of Cancellation

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the last item.

To exercise your right of cancellation, you must inform us (4D Herzog & Vitale OG, Kornmarktstraße 7, 6900 Bregenz, Austria, Tel.: +43 676 3008643, E-mail: service@4doutfitters.com) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model cancellation form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification concerning the exercise of your right of cancellation before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your cancellation of this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Premature Expiry of the Right of Cancellation

The right of cancellation does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.

The right of cancellation does not apply to contracts for the supply of goods that are liable to deteriorate or expire rapidly.

The right of cancellation does not apply to contracts for the supply of goods whose price depends on fluctuations in the financial market over which the trader has no control and which may occur within the cancellation period.

The right of cancellation expires prematurely in the case of contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

The right of cancellation does not apply to consumers who, at the time the contract is concluded, are not nationals of a Member State of the European Union and whose sole place of residence and delivery address are outside the European Union.

General Information

1. Please avoid damaging or contaminating the goods. Please return the goods to us in their original packaging, including all accessories and all packaging components. If necessary, please use protective outer packaging. If you no longer have the original packaging, please ensure that the goods are adequately protected against transport damage by using suitable packaging.
2. Please do not return the goods to us carriage forward or postage due.
3. Please note that compliance with points 1–2 above is not a prerequisite for the effective exercise of the right of cancellation.
